确权、协同与问责:政府职责体系改革下公安事权配置问题思考

摘要
公安机关事权配置是影响公安工作整体效能的重要因素,受行政性分权的制度影响,公安事权交叉重叠,事权结构具有明显的同质性;公安事权配置法治性不足,体现出以全国性"专项行动"为主导的"运动式治理"特征;公安事权下移与财权、编制严重不匹配.应立足于政府职责体系优化的宏观框架,以"确权"思维为导向,实现公安事权合理归位;以"协同"治理为目标,构建权责主体间合作伙伴关系;以"问责"控制为反馈,实现公安事权履责的闭环效应,从而稳步建构"以确权为战略先导、以协同为履职方式、以问责为监督反馈"的公安事权配置整体性格局.
Abstract
The allocation of powers by public security organs is an important factor affecting the overall effectiveness of public security work.It is an inevitable requirement for the moderni-zation of national governance system and governance ability to explore the mode of optimizing and reforming the allocation of public security power under the framework of government re-sponsibility system.Under the influence of the system of"administrative decentralization",pub-lic security power overlaps,and the structure of public security power has obvious homogeneity;the allocation of public security power lacks the rule of law;the allocation of public security power embodies the characteristics of'sports governance"dominated by national"special action";and the pressure under public security power does not match with financial power and estab-lishment seriously.Based on the macro background of the government responsibility system,we should take the thinking of"confirming the right"as the guide,realize the reasonable return of the public security power,take the goal of"coordination"as the guide,and construct the partner-ship between the subjects of power and responsibility.Accurately speed up the creation of a new pattern of public security power allocation with the right as the strategic guide,the cooperation as the way of performing duties,and the accountability as the supervision feedback.
