公安机关在高空抛物侵权案件中行使调查权,有利于保障各方当事人的合法权益,也是公安机关的法定职责,具有正当性.该调查权属于公权力,具有协助性、程序性、范围特定性的特点.公安机关在行使调查权时,可能面临与其他调查权竞合、调查内容不明确、法律效果规定模糊等困境.应严格区分公安机关的各类调查权,明晰公安机关调查权的内容,明确界定公安机关调查权的法律效果,完善公安机关调查权的保障措施.
Abstract
Public security authorities exercise their investigative powers in cases of high-al-titude object throwing tort,which is its statutory duty for safeguarding the legitimate rights and interests of all parties involved.This investigative power belongs to public authority and possess-es characteristics of being supportive,procedural,and specific in scope.When exercising their investigative powers,public security authorities may face challenges such as competition with other investigative powers,unclear investigation content,and vague legal effects.It is necessary to clearly distinguish between various types of investigative powers of public security authorities,clarify the content of the investigative power system,define the legal effects of public security authorities'investigative powers,and improve measures to safeguard these investigative powers.
