论袭警罪"暴力袭击"行为的合比例性认定

摘要
"暴力袭击"行为是袭警罪适用的核心要件.形式性、抽象地将"暴力袭击"理解为行为因果性地造成了警察受伤的形式说会不当扩大袭警罪的打击范围.应该对"暴力袭击"进行实质解释,将其界定为有意针对警察人身的、暴力程度实质性影响警察执法权行使而为社会不容许的恶性行为.但学界对"暴力袭击"实质判断所提出的突袭性标准依然存在与法益判断脱钩、不易于罪名区分等问题,有必要用合比例性标准取代突袭性标准.根据合比例性标准,对"暴力袭击"行为的认定应综合衡量行为人的暴力和警力的合比例关系.当暴力不合比例地超出了警力的使用范围,造成了警力的消耗,该暴力行为就属于刑法应该处罚的暴力袭击警察行为.
Abstract
The act of"violent attack"is the core element applicable to the crime of assaulting police.Formally and abstractly understanding"violent attack"as a causal act that causes police injuries would improperly expand the scope of attack on police officers and is not advisable.A substantive explanation should be given to"violent attacks",which are defined as malicious acts intentionally targeting the police,and the degree of violence that materially affects the exercise of police law enforcement power and is not allowed by society.However,there are still issues with the surprise criteria proposed by the academic community for the substantive judgment of"violent attacks",such as being disconnected from legal interest judgments and making it difficult to distinguish charges.It is necessary to replace the surprise criteria with proportional criteria.According to the proportionality standard,the determination of"violent attack"behavior should comprehensively measure the proportional relationship between the perpetrator's violence and police strength.When violence disproportionately exceeds the scope of police force usage,re-sulting in the depletion of police force,this violent behavior belongs to the criminal law's punish-ment of violent attacks on police officers.
