摘要
数据驱动的自动化决策技术的不断发展推动了自动化行政的兴起.公众参与自动化行政对于助推数字法治政府建设、防范算法权力滥用具有显著的积极作用.然而,自动化行政过程中的公众参与实践面临缺乏法律依据、参与渠道有限、参与能力不足、参与效果欠佳等问题.加强自动化行政过程中的公众参与,应以技术性正当程序理论为支撑,完善决策参与、过程参与、末端参与三个阶段的制度建设,对包括行政相对人在内的社会公众予以全过程、全方位赋能.未来应从厘定公众参与的边界、明确原理说明的义务、设定人工干预请求权等方面入手,构建和完善公众参与自动化行政的机制.
Abstract
How to better respond to dynamic risks in modern society places high demands on the dialogue mechanism between the two.On the one hand,the emergence of risks serves as a guiding function for decision-making in social governance;on the other hand,social governance anticipates potential risks and adjusts to those already present.A constructive dialogue mechan-ism between the two is needed to facilitate smooth communication.The paper analyzes the oc-currence of interactive relationships and builds two logical models based on the starting points of risk and the rule of law,describing the dialogue that is always in motion and forming an under-standing.From a strategic perspective,the paper extracts consensus factors from dynamic relati-onships,eliminates noise factors,reduces communication costs,and clarifies the interaction be-tween the rule of law and risk,providing theoretical support for the role of the rule of law in ad-dressing risks in social governance.
