摘要
社会治理如何更好地回应现代社会的动态风险,这对二者的对话机制提出了较高的要求.一方面,风险的出现对社会治理的决策发挥着指向标的功能;另一方面,通过实行社会治理对可能出现的风险进行预警,并对已出现的风险进行调整.二者之间需要保持良性的对话机制以寻求沟通的无碍.厘清其双方交互关系的发生方式,立足于构建两种逻辑模型,分别站在风险与法治的出发点,对此种始终保持在动势之中的对话进行画像,形成认识.从对策的角度,提取动态关系中的共识因素,并对噪声因子进行剔除,进而减低沟通成本投入,实现法治与风险交互关系的明晰化,为社会治理中法治面向风险的作用机制提供理论支持.
Abstract
In a risk society,how to better respond to risks in social governance places high demands on its dialogue mechanism.Clarify the logic of the interaction between risk and the rule of law,clarify the mode of interaction between the two parties,and construct a logical model from the starting point of risk and the rule of law.Picture and form an understanding of this dialogue that has always been in motion.From the perspective of countermeasures and improvement,fur-ther reduce the noise of dialogue,extract consensus factors from dynamic logic for construction,reduce unfavorable communication costs,and eliminate factors that impair sound propagation.
