摘要
我国附条件不起诉制度具有适用范围狭窄、适用条件严格的特点,导致司法实践中制度适用率偏低,且存在司法适用空间受相对不起诉制度侵蚀问题,制度功能及效应未能彰显.基于提升社会治理水平和深化司法改革现实背景,附条件不起诉制度适用有必要进一步拓展.实体层面,从案件范围、适用条件、附带义务三个方面扩充附条件不起诉制度适用内容;程序层面,围绕实体内容完善配套程序,主要涉及公开听证程序、监督考察程序及检察裁量权监督制约机制构建.
Abstract
The conditional non-prosecution system in China has the characteristics of narrow application scope and strict application conditions,which results in a low application rate of the system injudicial practice.There is a problem of judicial application space being eroded by the relative non-prosecution system.The system function and effect have not been fully demonstra-ted.Based on the practical background of improving social governance level and deepening ju-dicial reform,it is necessary to further expand the application of the conditional non-prosecution system.In terms of the substantive system,we should expand the application content of the con-ditional non-prosecution system from three aspects:case scope,application conditions,and inci-dental obligations.In terms of procedure,we should improve supporting procedures around sub-stantive content,involving the construction of public hearing procedures,supervision and inspec-tion procedures,and the supervision and restriction mechanism of prosecutorial discretion.
