Criticism of the Viewpoint that"Compliance Originates from Criminal Policy"
Compliance scholars bypass the limitations of the principle of legality in criminal law and use flexible criminal policies to build a theoretical basis for compliance.However,the path of misinterpreting the criminal policy of combining leniency with severity and the principle of severe punishment does not fully demonstrate the correlation between compliance and crimi-nal policy.Interpreting the combination of leniency and severity as mild and severe,and interpre-ting mild and severe as a prerequisite for compliance,are both misunderstandings of China US criminal policies.There are significant differences in social background and internal logic be-tween China's leniency and severity criminal policy and the United States'leniency and severity criminal policy.The compliance theory itself cannot match the leniency and severity criminal policy,so compliance and criminal policy are not relevant.
