数字时代行政公益诉讼检察建议的发展与完善

摘要
检察建议作为行政公益诉讼的诉前程序,属于一种"柔性"检察监督手段.数字技术既能拓宽其线索范围,加强科学取证固证,保障检察建议质效,又能衍生和拓展行政公益诉讼检察建议新领域.数字时代的行政公益诉讼检察建议仍面临质效不高、与公益诉讼衔接不足、落实监督不强以及算法风险等问题,应借助数字技术提升检察建议质量,从实体上加强检察建议内容的可操作性、从程序上重视检察建议书的有效送达、从技术上利用大数据平台实现检察建议与诉讼请求有效衔接;应建设智慧平台,组织听证、磋商,采用公开送达方式落实检察建议的监督效果;应厘定检察智能化数据利用与公民隐私权保护之边界,并规避数据算法蕴含的安全风险.
Abstract
As a pre-litigation procedure of administrative public interest litigation,procura-torial suggestion belongs to a"flexible"means of procuratorial supervision.Digital technology can not only broaden its clue scope,enhance scientific evidence confirmation,and ensure the quality and effectiveness of procuratorial suggestions;but also derive and expand new areas of administrative public interest litigation procuratorial suggestions.In the digital age,administra-tive public interest litigation procuratorial suggestions are still faced with problems such as low quality and effectiveness,insufficient connection with public interest litigation,weak implemen-tation supervision,and algorithm risks.The quality of procuratorial suggestions should be impro-ved by means of digital intelligence technology,the operability of the content of procuratorial suggestions should be strengthened substantively,the effective delivery of procuratorial sugges-tions should be emphasized procedurally,and the effective connection between procuratorial sug-gestions and litigation requests should be realized technically by using big data platform.Intelli-gent platforms should be built,hearings and consultations should be organized,and public service should be adopted to promote the supervision effect of the implementation of procuratorial sug-gestions.The boundary between intelligent data utilization and citizen privacy protection should be determined,and the security risks contained in data algorithms should be avoided.
