With the advent of the artificial intelligence era,the emergence of generative arti-ficial intelligence such as ChatGPT has sparked heated discussions in the social and economic fi-elds.However,compared to the keen attention paid by the social and economic fields to generat-ive artifiicial intelligence such as ChatGPT,the legal community,especially the Chinese criminal law community,is in a serious lagging state of attention to generative artificial intelligence such as ChatGPT.That is to say,the thinking of the criminal law community on issues related to gen-erative artificial intelligence such as ChatGPT is mostly based on its tool and technological es-sence,and it is believed that the independent criminal law regulation of generative artificial in-telligence such as ChatGPT does not have practical significance.However,these views do not take into account that generative artificial intelligence such as ChatGPT will inevitably develop into the essential stage of intelligent intelligence.The intelligentization of generative artificial in-telligence such as ChatGPT in the essential stage of intelligent intelligence is inevitable and can easily lead to illegal and criminal activities.Therefore,the protective function of criminal law cannot be weakened,and there should be no disconnection between criminal law theory research and the development of generative artificial intelligence such as ChatGPT.Therefore,there is no unified and universal standard for criminal law regulation of generative artificial intelligence such as ChatGPT,and it is necessary to take its own essential characteristics at different stages as a premise,that is,the regulation of criminal law in different essential stages of generative artifi-cial intelligence such as ChatGPT is absolutely different.
