Future Path of Improving Decision Efficiency of Grassroots Prosecutorial Committees under the "Dual Deliberation" Structure
The Working Rules of the Procuratorial Committee of the People's Procuratorate delineates the scope of evaluation of the procuratorial committee in a binary manner,presenting a"dual deliberation"pattern of"proposal"and"deliberation",enabling the procuratorial committee to play the functions of decision-making,guidance,and supervision.In practical operation,the grassroots procuratorial committee under the"dual deliberation"structure exhibits an imbalance in the proportion of"deliberation"and"proposal",an imbalance in responsibilities,and a virtual evaluation process.Therefore,the development of the grassroots procuratorial committee system with Chinese characteristics in the new era should focus on implementing the judicial responsibility system.By optimizing the participants,promoting the implementation of responsibilities,and strengthening the connection of procedures,resolutions can be made more professional,powers and responsibilities more balanced,and evaluations more efficient.
