The supplementary provision of refusing to fulfill information network security management obligations implies that China attaches great importance to the prevention and governance of cybercrime activities,showing a clear intention of criminal legislation to prevent and control cybercrime risks.Statistical analysis of relevant cases shows that problems exist in judicial practice,including inefficient protection of legal interests,wrong targets of punishment,and ineffective measures.Public-private partnership governance should be adopted in criminal compliance to make clear the responsibility of the network management subject and get rid of the empty provisions with the rectification and compliance plan.
