Research on the Regulation of Cross-Market Competition among Platform Enterprises under the Development of a Digital Ecosystem
With the development of the digital ecosystem,the application of leverage theory has limitations.Thus,it is difficult to judge the legitimacy of platform enterprises'cross-market competition behavior.Digital Market Act,newly issued by the European Union,is intrinsically related to the leverage theory.The Act clearly considers enterprises'cross-market behavior when identifying gatekeepers and setting bans.Meanwhile,the Act transforms the unreasonable design of leverage theory,which is more in line with the behavior characteristics and regulatory needs of Chinese enterprises in the digital age.In the absence of regulatory experience,China needs to imitate the European Union model and localize regulatory measures.On the one hand,on the basis of establishing the platform classification and grading system,China can prudently introduce the concept of regulatory subject similar to gatekeeper,so as to prevent enterprises from abusing dominant power across the market by pre-engaging.On the other hand,China needs to loosen the requirements for proving the competitive effects of such actions,and extend the analysis unit to the cross-market ecosystem,so as to comprehensively consider the competitive impact brought by corporate behaviors.
