On the Public-Private Collaborative Governance in Climate Rule of Law
Public-private collaboration should be regarded as the fundamental model of climate governance and the institutional logic of climate rule of law.This approach is not only an inevitable path to achieving the Carbon Peak and Carbon Neutrality goals but also requirements for improving the adaptation measures and for integrating public and private attributes in climate rule of law.With the public-private collaboration,all entities should act based on discourse rationality based on a risk response system with climate information as"node".The climate legal system should reflect the institutional logic of public-private collaboration in three aspects:subjects,governance framework and legal order.That is,to promote the decision-making mechanism based on collaborative co-governance,to establish a framework based on sufficient information communication,and to create a climate law order through the coordination between public and private laws.
