On Reshaping and Structural Optimization of the Scope of Regulatory Objects in Organic Law of the Local People's Congresses and Local People's Governments of the PRC
In order to adapt to the democratic and legal construction needs in the initial stage of reform and opening up,Organic Law of the Local People's Congresses and Local People's Governments o f the PRC in 1979 adopted an"expansionary"strategy in determining the scope of regulatory objects,with"there being laws to abide by"becoming the top value demand for legislation at that time.After the establishment and improvement of the legal regulatory system related to state institutions,the legislative function of Organic Law of the Local People's Congresses and Local People's Governments of the PRC began to overlap with that of other laws,posing a challenge to the stability of laws and the unification of the national legal system.Therefore,the"expansionary"scope of regulatory objects faced the need for re-examination and strategic adjustments.The reshaping of the scope of regulatory objects in Organic Law of the Local People's Congresses and Local People's Governments of the PRC should exclude alternative legislative functions based on the clarification of the scope of regulatory ob-jects of related laws,thus achieving the self-renewal and coordinated unification of the legal system of state institutions in the new era.
