The Problem of Surrogacy in China:"Lack of Legal Basis"and Regulatory Ideas
"The Management Measures for Human Assisted Reproductive Technology"issued by China in the early 21 st century mainly contains departmental regulations implemented to address the serious challenges that surrogacy technology brings to traditional morality,ethics,and law,in order to demonstrate the country's attitude towards surrogacy technology suppression.However,this law has not played its due role in judicial practice and has become a"zombie clause".The reasons for this are:firstly,its effectiveness level is relatively low;the second is limited applicability.At present,the issue of surrogacy in China is in an"unreliable"state,providing an opportunity for malicious surrogacy.In view of this,the issue of surrogacy should be placed under the rule of law as soon as possible,and technology should be used reasonably and legally to benefit humanity.
