论单一法益视角下的职务侵占罪

摘要
传统的刑法理论认为职务侵占罪是从贪污罪中分离出来的,因此对于职务侵占罪"利用职务上的便利"以及行为方式和所侵犯的法益认定,均是参照贪污罪进行理解与适用.但对职务侵占罪的理解不应脱离刑法所欲保护的法益视角,应坚持单一法益侵犯说,以侵占罪为参照标准.对"利用职务上的便利"应从"职务"与"便利"两方面进行综合考量,其行为方式应仅限于侵占.
Abstract
Traditional criminal law theory holds that the crime of embezzlement is separated from the crime of corruption,so the understanding and application of the crime of embezzlement by taking advantage of one's position,as well as the modes of conduct and the legal interests infringed,are all based on the understanding and application of the crime of corruption.Howev-er,the understanding of the crime of embezzlement should not be separated from the perspective of legal interests protected by criminal law,and the theory of single legal interest violation should be adhered to,with the crime of embezzlement as the reference standard.The"taking advantage of one's position"should be comprehensively considered from both"position"and"advantage",and its modes of conduct should be limited to embezzlement.
