危险作业罪中"现实危险"的判断方案——以体系性和类型性思维切入

摘要
"现实危险"的准确认定是判断危险作业行为是否构成危险作业罪的关键,应围绕"现实危险"的基本特征构建判断体系.在判断体系中,现实性无需单独审查,应以重大性和紧迫性的判断为核心.在判断标准上,应从事后查明的全部客观事实出发,以一般人的生活经验法则为基准.在方案设计上,应以类型性思维区分"事故型"案件和"状态型"案件,差异化构建"现实危险"判断方案.
Abstract
The accurate identification of"actual danger"is the key to determining whether a dangerous operations behavior constitutes the crime of dangerous operations.A judgment sys-tem should be constructed around the basic characteristics of"actual danger".In this system,the reality need not be examined separately;instead,the focus should be on the judgment of sig-nificance and urgency.As for the judgment standard,it should start from all the objective facts established after the event,using the general rule of thumb in everyday life as a benchmark.In terms of scheme design,differentiated approaches should be taken to distinguish between"acci-dent-type"cases and"state-type"cases,and to construct differentiated judgment schemes for"actual danger".
