Conflict and Coordination Between Collective Labor Law and Antitrust Law From the Perspective of Workers'Labor
In order to protect the rights and interests of workers in a vulnerable position and achieve specific social policy goals,the antitrust law has established labor exemption provi-sions.However,with the development of the platform and digital economy,employees of new business models without employee status are easily regarded as"enterprises"with economic en-tity status in the antitrust law,making it difficult to apply the traditional antitrust labor exemp-tion.This article analyzes the opposition and coordination between collective labor law and anti-trust law from the perspective of workers'labor,and offers institutional guidance for equal con-sultation,fair competition,the creation of a favorable labor environment,and the comprehensive development of workers.
