人工智能时代声音侵权的私法规制
Private Law Regulation of Sound Infringement in the Era of Artificial Intelligence

摘要
人工智能时代声音处理技术逐渐完善,声音利用与侵犯呈现多元化趋势.现有法律对声音权保护不足.自然人声音权是独立的具体人格权,具有财产价值与精神价值.对声音权保护应把握声音侵权类型特点,考虑声音权价值突出、保护意识淡薄等侵权频发诱因.人工智能时代下声音权保护路径可参照肖像权有关规定,积极适用人格权禁令制度,依法确定侵权责任,推动声音侵权私法规制的进一步完善.
Abstract
In the era of artificial intelligence,sound processing technology is gradually improved,and the use and infringement of sound show a diversified trend.The protection of sound rights in existing laws is insufficient.The voice right of natural person is an independent specific personality right,which has property value and spiritual value.For the protection of sound rights,we should grasp the characteristics of the types of sound infringement,and consider the frequent causes of infringement such as the prominent value of sound rights and the weak awareness of protection.In the era of artificial intelligence,the protection path of sound right can refer to the relevant provisions of portrait right,actively apply the prohibition system of personality right,determine the tort liability according to law,and promote the further improvement of the private law regulation of sound tort.
