The Application Dilemma and Reconstruction of the Reasonable Use System for Artificial Intelligence Input Terminals
Artificial intelligence reads and collects a large amount of expressions from works on the input end,which may pose a risk of infringing on the exclusive rights of copyright owners.In this context,compared to statutory and compulsory licenses,it is more reasonable to apply the reasonable use system to regulate the use of works by AI input terminals.However,due to the long-term existence of"author-centeredness",the reasonable use system has always been in a subordinate position,and the existing legal provisions do not meet the requirements of the big data era.Therefore,the construction of the reasonable use system can be interpreted loosely from the perspective of interpretivism,internal repairs can be made to existing regulations from the perspective of legislation,the introduction of the four element test method can be introduced,and reasonable use provisions can also be added.
