摘要
司法实践中正当防卫的认定现状不容乐观,由于对不法侵害的错误理解、对紧迫性的不正确认识、过分强调武器对等原则、对正当防卫的唯结果论等原因,导致正当防卫往往被防卫过当化.需要对正当防卫的认定进行纠偏,从起因、动机、时间、限度、结果等多维度厘清其认定标准,使刑法中该条款不再沦为"僵尸条款",使公民的正当防卫权真正落到实处.
Abstract
The current situation of the recognition of justifiable defense in judicial practice is not optimistic.Due to misunderstandings of illegal infringement,incorrect understanding of urgency,excessive emphasis on the principle of weapon equivalence,and a result oriented approach to justifiable defense,justifiable defense is often overemphasized.It is necessary to correct the recognition of justifiable defense,clarify its recognition standards from multiple dimensions such as cause,motive,time,limit,and result,so that this provision in the criminal law will no longer become a"zombie clause",and truly implement the citizen's right to justifiable defense.
