同意原则作为处理个人信息处理的正当性基础,在消费者权益保护领域中存在先天的"基因缺陷".可从同意的主体、知情的前提以及构成要件等维度厘清同意原则的规范意涵.同意原则的效力应放置在《民法典》《个人信息保护法》以及《消费者权益保护法》等多重法律体系内考察,因此应从明确性和建立个人信息追踪制度等方面对同意规则进行规范.
Abstract
The principle of consent,as the legitimate basis for processing personal information,has inherent"genetic defects"in the field of consumer rights protection.The normative implications of the principle of consent can be clarified from the dimensions of the subject of consent,the premise of knowledge,and the constituent elements.The effectiveness of the consent principle should be examined within multiple legal systems such as"The Civil Code","Personal Information Protection Law",and"Consumer Rights Protection Law".Therefore,the consent rules should be regulated from the aspects of clarity and the establishment of a personal information tracking system.
