习近平法治思想中的党内法规和国家法律关系论

在中国特色社会主义法治体系的语境之下,坚持依法治国和依规治党有机统一,实现党内法规和国家法律的衔接和协调,前提和基础就是正确认识并厘清党内法规和国家法律的关系问题.习近平法治思想深刻回答了党内法规和国家法律的关系问题,可以主要概括为以下五个命题,即:党内法规异于国家法律,党内法规融通国家法律,党内法规严于国家法律,国家法律高于党内法规,党内法规先于国家法律.新时代新征程上,应当坚持以习近平法治思想为指引,充分释放党内法规在治国理政中的强大治理效能,切实发挥党内法规和国家法律各自的功能优势,协同保障依法治国和依规治党的一体建设、统筹推进,以利于全面依法治国总目标的最终实现.
On the Relationship Between Intra-Party Regulations and National Laws in Xi Jinping Thought on the Rule of Law
Under the context of the socialist rule of law system with Chinese characteristics,as for adhering to the organic unity of the rule of law and the rule of the Party in accordance with rules and regulations,and for realizing the convergence and coordination of the intra-Party regulations and national laws,the prerequisite and basis is to correctly understand and clarify the relationship between the intra-Party regulations and national laws.Xi Jinping Thought on the Rule of Law has profoundly answered the question of the relationship between the intra-Party regulations and national laws,which can be summarized in the following five propositions,namely,intra-Party regulations are different from national laws,intra-Party regulations are compatible with national laws,intra-Party regulations are stricter than national laws,national laws are higher than intra-Party regulations and intra-Party regulations are prior to national laws.In the new era and new journey,we should adhere to Xi Jinping Thought on the Rule of Law as a guide,fully release the powerful governance effectiveness of the intra-Party regulations in the governance of the country,effectively give full play to the functional advantages of the intra-Party regulations and national laws,and synergistically ensure that the rule of the nation by law and the rule of the Party in accordance with the rule of law are built as a whole,and integrated and promoted in a way that is conducive to the eventual realization of the overall objective of the nation's governance by law in all aspects.
