对重大疑难经济犯罪案件做精准辩护意义重大.精准辩护的原则包括利益最大化原则、专业化原则、手段多元化原则及多策略并用原则.重大疑难经济犯罪案件精准辩护的路径由案件事实确定、依据(政策、法律、立法/司法解释、类案、学术观点)确定、相关领域专家参与、最终辩护方向确定、与办案人员沟通、法庭辩护等阶段组成.在重大疑难经济犯罪案件辩护过程中,还需要从理念与措施两个层面进行尝试性探索,以此提升精准辩护的深度与广度.
Abstract
The precision defense of major and difficult economic crime cases is of great significance.The precision defense includes the principle of benefit maximization,the principle of specialization,the principle of means diversification and the principle of multi-strategy.The path of precision defense of major and difficult economic crime cases consists of the determination of the case facts,the determination of the basis for judgment,the participation of experts in related fields,the determination of the final defense strategy,communication with case officers,and court defense.It is also necessary to make a tentative exploration from both thoughts and measures to improve the depth and breadth of precision defense.
