Practice of Dispute Resolution in Resident Mediation:Operation Logic,Problems and Reform Approach
As a traditional oriental experience,the People's mediation system plays an important role in the settlement of conflicts and disputes in the society of acquaintances.Since the reform and opening-up,the non-full-time people's mediation mechanism has gradually declined under the influence of the Stranger Society formed by the acceleration of population mobility.At the same time,the thinking mode of"seeking help from the police"has made the limited police force immersed in the tedious individual disputes.The problems of some preliminary police officers being too old,lacking of civil law knowledge and too many cases lead to the frequent occurrence of public opinions related to non-police affairs,which need to be solved through institutional innovation.With government procurement,D City of Guangdong Province realizes the full-time operation of resident mediators to reduce the police situation and prevent the criminal transformation of conflicts,which provides a practical sample for the smooth operation of people's mediation.However,there are still some problems in the operation of resident mediation,such as too strong mobility of mediators,insufficient mediation experience and police knowledge reserve,and insufficient linkage of relevant institutions.Under the challenge of new-type disputes and the conflict of traditional contradictions,the optimization of resident mediation system still needs to upgrade in the aspects of dispute mediation skills refinement,classification of mediation cases,and coordinated promotion of long-term social governance.
