The number of drunk driving cases is increasing year by year,but the current treatment mode of detention or relative non-prosecution for drunk driving cases has drawbacks.The punishment mea-sures are contrary to the original intention of legislation,which are not accepted by the public.Al-though relatively non-prosecution has some effect,its function is limited.In contrast,the conditional non-prosecution system takes into account the dual attributes of"punishment"and"relief",which can help the criminal to return to society while punishing him/her.At present,it is urgent to establish a conditional non-prosecution mechanism for drunk driving cases,give play to the subjective initiative of pro-curatorial organs,set up corresponding conditional non-prosecution procedures for drunk driv-ing offenders,and accept extensive social supervision on relevant cases.
