摘要

证明责任裁判方法贯穿民事诉讼的整个过程,其本质为法律适用问题.实践中因对证明责任方法论功能的误识,认为证明责任裁判方法只有在证据短缺、案件事实落入真伪不明时才被适用.备受争议的"人狗猫大战"案判决中的缺失,正是因为证明责任裁判方法欠缺所导致.
