RCEP Cross-Border Data Flows:A Review of the Rules and China's Response
The Regional Comprehensive Economic Partnership(RCEP)is the world's largest FTA,containing rules for digital trade and cross-border data flows.RCEP requires members to guarantee the free flow and security of data,and does not force data localization.In order to adapt to and utilize the rules of RCEP and promote cooperation in the digital economy,China should,on the premise of maintaining national sovereignty and security,improve the cross-border laws on data,clarify the standards and procedures for data classification and management,establish a risk assessment and supervision mechanism for data flow,and strengthen the protection and of data flow with RCEP member countries.The paper puts forward measures and suggestions that China should take to provide reference and lessons for the development of digital trade in China under the framework of RCEP.
