Research on the plaintiff subject system of marine environmental public interest litigation in China
The ocean is an important base for national strategic resources.Therefore,a fair and efficient marine environmental public interest litigation system is particularly important.This paper takes 75 cases as samples to analyze the specific status of the plaintiff in the judicial practice of marine environmental public interest litigation.In view of the problems found that the connection between different relevant legal provisions is not close enough,the internal functions and powers of marine environmental supervision and management agencies are vague,and the scope of the plaintiff's body is narrow,suggestions are put forward to strengthen the coordination among relevant legal provisions,clarify the division of functions and powers of marine environmental supervision and management agencies,and add social organizations as supplementary subjects.This aims to further promote the continuous improvement of the marine environmental public interest litigation system and strengthen judicial protection of the marine ecological environment.
