Onlegal liability for the sale of fish caught illegally in closed fishing areas or during closed fishing periods
Due to the absence of the second paragraph of Article 38 of the current Fisheries Law of the People's Re-public of China on the punishment of the sale of illegally caught fish in the prohibited fishing zone or during the pro-hibited fishing period,this behavior is not well regulated by law,which seriously damages the sustainable develop-ment of fishery resources.This paper expounds the related concepts and harms of selling the illegal catch in the closed fishing area or during the closed fishing season,analyzes the necessity of perfecting the penalties in the Fish-eries Law,and puts forward the elements of legal liability and legislative suggestions.
