Research on the legal issues of marine engineering construction project in vio-lation of the provisions of marine environmental protection law
With the proposal of marine power strategy,marine resources will be further developed and utilized,but because of the complexity of marine environment,the limitation of human development technology and the blindness of marine development,the marine environment will be affected to varying degrees when people carry out marine development.Based on the current situation of marine engineering construction project behavior,combined with the marine Environmental Protection Law of People's Republic of China and relevant laws,this paper analyzes the be-havior of marine engineering construction project in violation of the regulations.It is found that there are problems such as unclear division of responsibilities of relevant departments,insufficient punishment for marine environmen-tal damage,imperfect recovery mechanism for marine environmental damage,and small scope of subjects to bring marine environmental public interest litigation.From improving the identification of relevant responsible subjects,strictly specifying legal responsibilities,and improving supporting mechanisms for environmental restoration,impro-ving suggestions are put forward based on measures such as increasing the subject qualification for filing public in-terest litigation,so as to standardize the construction behavior of ocean engineering and promote the healthy devel-opment of ocean exploitation activities.
