Research on compensation for endogenous pollution damage in marine aqua-culture
This paper mainly studies the problem of endogenous pollution in marine aquaculture, including pollution from feed and fishery drug use,and analyzes related legal provisions and judicial status quo.It points out that en-dogenous pollution poses a threat to the ecological environment, but there are unclear issues in the legal standards of pollution sources, scope of damages, compensation standard, and liability of third parties. It proposes targeted solutions to address these problems, including improving the standards of marine aquaculture inputs, expanding the scope of damages, establishing a comprehensive assessment mechanism to regulate compensation standard, and ap-plying a combination of subjective and objective standards to determine the liability of third parties. It emphasizes that by studying these issues,it can better safeguard social public interests and protect the marine environment.
