习近平法治思想引领下未成年人检察公益诉讼的制度优化

摘要
检察公益诉讼是习近平法治思想在公益保护领域的生动实践与具体运用.为践行这一思想,2020年《未成年人保护法》修订新增了未成年人检察公益诉讼制度.该制度的提出与运行是基于国家对于未成年人权益的保护责任,以及与公益保护诉讼形态的高度契合.同时,也需要遵循未成年人发展性与身份独特性,对公益诉讼目的进行扩张,并延伸公共利益的内涵.未成年人检察公益诉讼制度实践存在公益标准模糊、线索来源单一、内部分工不合理、案件启动程序不畅、检察建议质效欠佳与持续监督缺位等一系列问题.对此,有必要在习近平法治思想的指引下,采取明晰案件范围、推广运用观察员制度、加强多部门协同合作、明晰起诉顺位、规范适用诉前检察建议、加强事后跟踪督促等措施予以完善.
Abstract
Procuratorial public interest litigation is the practice and specific application of Xi Jinping's Thought on the Rule of Law in the field of public interest protection.In order to implement this idea,Law on the Protection of Minors in 2020 was revised and the procuratorial public interest litigation system was added.The pro-posal and operation of this system are based on the state's responsibility to protect the rights and interests of mi-nors,and is highly consistent with the form of public interest protection litigation.At the same time,it is also neces-sary to follow the development and unique identity of minors,expand the purpose of public interest litigation,and extend the connotation of public interest.There are a series of problems in the practice of the procuratorial public in-terest litigation system for minors,such as vague public interest standards,single source of clues,disordered inter-nal division of labor,poor case initiation procedures,poor quality and effectiveness of procuratorial suggestions,and lack of continuous supervision.In this regard,it is necessary to adopt measures to improve the scope of cases,promote the use of the observer system,strengthen multi-department collaboration,clarify the order of prosecution,standardize the application of pre-litigation procuratorial suggestions,and strengthen post-action follow-up and su-pervision under the guidance of Xi Jinping's Thought on the Rule of Law.
