摘要
公安机关作为直接处置违法未成年人的主要国家机构,在对违法未成年人这一群体的国家保护方面尚存在不足.这不仅损害了未成年人法律体系的完整性与一致性,而且也削弱了在执法过程中对未成年人应有的特别保护措施.当下未成年人警务法律制度存在法律供给不足、过度保护加害者引发恶性循环、部分法律规定不明确和法律监督救济机制不健全等问题.而未成年人法律处置缺乏顶层设计、多部法律对未成年加害者的多重保护性要求、立法技术的局限和法律监督救济程序供给不足是造成以上问题的主要原因,必须通过实现未成年人法律制度法典化、明确违法未成年人处置法律条款、建立违法未成年人分级处置法律机制和健全违法未成年人法律监督救济机制等途径来完善未成年人警务法律制度,以保障未成年人权利,维护社会稳定.
Abstract
The public security authorities,as the main national-level agencies that deal directly with minors in conflict with the law,have not yet been able to provide adequate national-level protection for minors in conflict with the law as a group.This not only jeopardizes the integrity and consistency of the legal system for minors,but also weakens the special protection measures for minors that should be in place during the law enforcement process.The current legal system for the policing of minors is plagued by problems of insufficient legal provision,overprotection of victimizers leading to a vicious circle,unclear provisions in some of the laws,and inadequate mechanisms for legal supervision and relief.The lack of top-level design of the legal disposition of minors,the multiple protective requirements of multiple laws for minor aggressors,the limitations of the legislative technology and the insufficient supply of legal supervision and relief procedures are the main reasons for the above problems,which must be realized through the codification of the legal system for minors,the clarification of the legal provisions of the disposition of minors in conflict with the law,the establishment of the legal mechanism of the disposition of minors in conflict with the law in a graded manner,and the improvement of the law of minors in conflict with the law.The legal system for the policing of minors must be improved by codifying the legal system for minors in conflict with the law,clarifying the legal provisions for the handling of minors in conflict with the law,establishing a legal mechanism for the graded handling of minors in conflict with the law,and improving the legal mechanism for the supervision and relief of minors in conflict with the law.
