摘要
行政许可容缺受理制度的框架构建,一方面需要社会信用体系为其适用前提和责任追究提供风险防控机制;另一方面需要通过主次申请材料的合理区分有效调和受理程序的革新与许可条件的规范约束之间的冲突,避免容缺受理异化为容缺办理.但行政许可容缺受理在实践中仍面临着合法性诘问、适用条件松紧不一、适用事项泛化以及失信惩戒措施合理边界模糊等现实问题.针对这些问题,可借鉴总体类推的漏洞填补方式对其进行正当性释疑,以统一基准的方式框定行政许可容缺受理的适用边界,并在失信惩戒措施的采用上遵循比例原则以实现手段与目的之间的平衡.
Abstract
The construction of the framework for the acceptance system of administrative licensing deficiencies requires,on the one hand,the social credit system to provide a risk prevention and control mechanism for its application premise and accountability;On the other hand,it is necessary to effectively reconcile the conflict between the innovation of acceptance procedures and the normative constraints of licensing conditions through reasonable differentiation of primary and secondary application materials,so as to avoid the differentiation of acceptance of deficiency into deficiency of handling.However,in practice,administrative licensing acceptance still faces practical problems such as legitimacy questioning,inconsistent application conditions,generalization of application matters,and blurred reasonable boundaries of disciplinary measures for dishonesty.In response to these problems,we can draw lessons from the overall analogy of filling loopholes to clarify its legitimacy,frame the application boundary of administrative license acceptance in a unified benchmark,and follow the principle of proportionality in the adoption of dishonesty punishment measures to achieve the balance between means and purposes.
