There is a mismatch between specialized corrective education and other graded intervention measures for juvenile delinquency.Guided by the principles of being most beneficial to minors,proportionality,and individualization,the selection of graded intervention measures should consider behavioral and human factors,and comprehensively evaluate the necessity of minors receiving education and correction.To address the issue of disproportionate intervention measures for juvenile delinquency,the first step is to clarify the protective nature and punishment color of specialized corrective education,clarify the applicable conditions through reasonable explanations"when necessary",and improve the quasi judicial application procedures.Finally,from three aspects:the early intervention of the prosecution to facilitate the transfer of the investigation stage,the refinement of the supervision and inspection of conditional non prosecution,and the expansion of the non punitive path for probation and parole offenders,we will construct a specialized mechanism for the transfer of corrective education and criminal treatment measures,and further optimize the hierarchical intervention system for juvenile offenders.
