摘要
面对当前国际反兴奋剂治理能力不足的危机,世界反兴奋剂机构陆续通过了一系列改革方案,但世界反兴奋剂机构独立化改革深受桎梏由来已久,尤其是"监守自盗"的困局依然需要进一步破解.共商共建共享的全球治理理念为破解当前困境,构建国际反兴奋剂新模式提供了科学的中国方案.世界反兴奋剂机构作为由不同类型股东构成的多股东、多层级组织,当面对比较复杂和动荡的外界环境时,更适合采用由利益相关者共同承担治理责任的"新型蜂窝状治理结构",因此建立由更多利益相关方参与的理事会,构建扁平化的管理结构,创建更丰富更开放更灵活的治理参与机制,理顺理事会、执委会和委员会的彼此关系,配置防止股东权利滥用的预防救济机制等一系列举措,正是共商共建共享理念在国际反兴奋剂治理新模式构建中的贯彻落实.
Abstract
Faced with the crisis of inadequate capacity in international anti-doping governance,the World Anti-Doping Agency(WADA)has successivelg adopted a series of reform proposals.However,the independence reform of WADA has been long shackled,and particularly,the dilemma of"the guard stealing the jewels"still needs to be further resolved.The global governance concept of extensive consultation,joint contribution,and shared benefits provide a scientific Chinese solution for breaking the current dilemma and constructing a new international anti-doping model.As a multi-shareholder and multi-level organization composed of different types of shareholders,WADA is more suitable to adopt a"new honeycomb governance structure"in which stakeholders jointly assume governance responsibilities when facing a complex and volatile external environment.Therefore,a series of measures such as establishing a council with more stakeholders'participation,constructing a flattened management structure,creating a richer,more open,and more flexible governance participation mechanism,straightening out the relationship among the council,the executive committee,and the commission,and configuring preventive and remedial mechanisms to prevent abuse of shareholder rights,are precisely the implementation of the concept of extensive consultation,joint contribution,and shared benefits in the construction of a new international anti-doping governance model.
