Research on the Definition of the Legal Attributes of Carbon Emission Rights in the Context of"Dual Carbon"
In order to achieve the goal of"double carbon",China actively promotes the action of"emission reduction and carbon reduction".Carbon emission trading is one of the important measures to promote the realization of the"dual carbon"goal.Due to the relatively vague definition of carbon emission rights,scholars have their own disputes about the legal attributes of carbon emission rights,in this case,there will be problems such as wrong application of law,untimely dispute resolution,and increased market uncertainty.After analyzing the current academic views of domestic scholars on carbon emission rights,this paper proposes a new type of property rights based on the dual attributes of public and private rights of carbon emission rights,accurately defines the nature of carbon emission rights,further optimizes and strengthens the role of the carbon emission trading system,and promotes the realization of the"double carbon"goal.
