Study on the Determination of Copyright Infringement of Self-media Manuscript Laundering in the Context of Socialized Reading
[Purposes]This paper aims to define the behavioral attributes of self-media manuscript laun-dering,analyze the dilemma of applying the traditional copyright infringement rules—"substantial simi-larity+contact"to the issue of self-media manuscript laundering,and explore a more operational method of self-media manuscript laundering infringement determination.[Methods]Starting from the manifestation of self-media manuscript laundering behavior and relevant conceptual analysis,the es-sence of self-media manuscript laundering behavior is clarified.Combing with domestic and interna-tional practice cases,the study analyzes the determination ideas of different"substantial similarity"judg-ment methods.[Findings]Manuscript laundering refers to the behavior of changing the expression through various ways,while remaining consistent with the basic meaning of the original text.In determin-ing infringement of copyright works,there are advantages and disadvantages of the"overall perception method","abstract separation method"and"combination method"in practice.[Conclusion]When com-paring the infringement of works,the logical chain of works can be considered as the main reference fac-tor.The"Combination Method"can be improved by first abstractly summarizing the content of the work,and then comparing the logical chain of the work from the perspective of an ordinary reader to see whether the manuscript laundering work will replace the original work.
