[Purposes]By analyzing the characteristics of commercial data,reflects on the existing difficul-ties,and explores the rationality of its inclusion in intellectual property protection.[Methods]Comparing the characteristics of commercial data and intellectual property rights and combing with the existing protec-tion model,This paper further analyzes the most convenient solution for regulating commercial data.[Findings]Commercial data is a"complex"with multiple intellectual property object attributes,and it is difficult to regulate it with a single traditional intellectual property law.[Conclusions]From the perspec-tive of intellectual property rights protection,a unified and comprehensive dual-track protection mecha-nism should be established,and legislation and judiciary should be promoted in coordination,so as to stimulate innovation and promote the stable development of China's digital economy.
