[Purposes]Through a comparative analysis of GUI design patent infringement cases,this pa-per finds out the shortcomings of the protection system for GUI design patents,raise issues and puts for-ward relevant suggestions for improvement.[Methods]By analyzing relevant cases,this paper sorts out the infringement judgment rules for GUI design patent infringement in judicial trials.[Findings]Due to the particularity of GUI appearance design,the protection of GUI appearance design patents can be ex-panded by refining the subject of infringement judgment,reducing the limitations of"products"on GUI appearance design and introducing indirect infringement rules.[Conclusions]With the development of science and technology,there will be more forms of GUI appearance design in the future,so it is neces-sary to perfect the protection of GUI appearance design in legislation and judicature.
