The Dilemma and System Improvement of Enterprise Data Trade Secret Protection
[Purposes]There are difficulties in identifying the legal attributes,rights ownership and pro-tection paths of enterprise data,So it is necessary to improve the existing legal system.[Methods]Com-bined with the current situation of digital development,the identification elements and relevant stan-dards of enterprise data trade secrets are clarified to solve the dilemma of difficult proof of right holders.[Findings]At present,there is a lack of relevant legislation on the protection of trade secrets of enterprise data.The current protection system and protection measures are ineffective,and the judicial determina-tion of enterprise data as trade secrets is relatively difficult.[Conclusions]It is suggested to actively pro-mote the special legislation on the protection of enterprise data trade secrets,and to supplement and im-prove the relevant laws and regulations on the protection of enterprise data.The protection idea of both civil and criminal law should be adopted to improve the effectiveness of the handling of enterprise data trade secret protection cases.
