摘要
[目的]解决短视频配音中的侵权纠纷问题.[方法]通过梳理相关案件,结合著作权法的相关法律法规等,对短视频配音在著作权上的独创性和合理使用进行分析.[结果]相关案例的判决结果表明,短视频配音的独创性结论和短视频独创性判定一致,高原创性的配音作品可被认为是合理使用.[结论]认定短视频配音作品满足的独创性标准在于"独创性"的有无,而不该上升到"艺术性";短视频配音作品的合理使用,关键在于获得许可和增强作品独创性.
Abstract
[Purposes]This paper aims to resolve infringement disputes in short video dubbing.[Methods]By sorting out relevant cases and combing with relevant laws and regulations of the Copyright Law,this paper analyzes the originality and fair use of short video dubbing in copyright.[Findings]The judgment results of the relevant cases show that the original conclusion of short video dubbing is consistent with the judgment of short video originality,and the dubbing work with high originality can be considered as fair use.[Conclusions]The criterion of originality that short video dubbing works meet lies in the pres-ence or absence of"originality"and should not rise to"artistry";The reasonable use of short video dub-bing works requires obtaining permission to use and enhancing the originality of the work.
