专利创造性审查制度存在的问题及因应

摘要
[目的]完善专利创造性标准和制度,提高专利质量,推动高质量发展.[方法]通过提出问题、分析问题、解决问题的方法,从判断标准、判断内容和判断的主观性分析审查制度存在的问题.[结果]专利创造性审查制度存在审查判断标准较低、审查内容片面、专利创造性判断存在主观性等问题.[结论]提出了完善专利创造性审查制度的三大建议,即优化专利创造性审查标准、充实专利创造性审查的内容、推进专利创造性判断标准的客观化.
Abstract
[Purposes]In order to improve the quality of patents and promote high-quality development,it is necessary to improve the standards and systems of patent creativity.[Methods]Through the methods of raising questions,analyzing problems and solving problems,the problems existing in the review system were analyzed from judgment criteria,judgment content and the subjectivity of judgment.[Findings]There are some problems in the patent creativity review system,such as low review judgment standard,one-sided review content,and subjectivity in patent inventiveness judgment.[Conclusions]Three sug-gestions are put forward to improve the system of patent creative examination,and that is,to optimize the standard of patent creative examination,to enrich the content of patent creative examination,and to pro-mote the objectification of patent creative judgment standard.
