利益博弈视域下UGC平台的版权授权许可研究

[目的]当前,用户的交互式创作频繁、便捷,传统版权授权许可制度面临新的挑战,需要拓宽版权授权许可的思路,降低主体间的博弈成本.[方法]从利益博弈的视角出发,通过对传统模式下版权授权许可困境的分析,寻求平衡创作者、平台和用户三方利益的途径.[结果]在UGC模式下,平台用户之间、平台与权利人之间存在着非合作博弈,使得用户生成内容无法得到良性传播,导致了集体利益的丧失.[结论]对于符合法定情形的用户生成内容使用相关作品行为,可以在合理使用的框架内进行解释;对于其他情形下的UGC授权许可问题,还需要多种举措以平衡不同用户之间及平台与用户之间的利益分配.
Research on Copyright Licensing of UGC Platform from the Perspective of Benefit Game
[Purposes]At present,users'interactive creation is frequent and convenient,and the tradi-tional copyright licensing system is facing new challenges,so it is necessary to broaden copyright licens-ing to reduce market costs.[Methods]From the perspective of benefit game,by means of analyzing the di-lemma of copyright licensing under traditional models,this paper seeks ways to balance the interests of creators,platforms,and other users.[Findings]Under UGC,there is a non-cooperative game between platform users and between platform and creators,which prevents the benign dissemination of user gener-ated content and leads to the loss of total profit.[Conclusions]Those in compliance with legal circum-stances can be provided within the framework of reasonable use;In other cases,multiple initiatives need to be utilized to balance the distribution of benefits among different users and between platforms and us-ers.
