摘要
[目的]分析NFT数字藏品铸造过程中的法律问题,探索其形成过程中的财产价值.[方法]运用文献研究法和案例研究法,分析NFT数字藏品铸造行为的法律属性.[结果]铸造行为的结果是产出NFT数字藏品.NFT具备作品的实质要件"独创性",其是一件独立作品,而非原作品的复制品.NFT代币化背后的数字作品复制品没有"稀缺性",不具有价值,而锻造行为也并未给NFT增值,NFT数字藏品本身不具有价值.[结论]NFT数字藏品的价值性主要来自铸造行为之外的版权授权或者是"更傻者理论".
Abstract
[Purposes]This paper analyzes the legal issues in the casting process of NFT digital collection and explores the property value in the formation process.[Methods]This paper analyzes the legal attri-butes of NFT digital collection casting by using literature research and case study.[Findings]The result of the casting act is the digital collection of NFT,which has the essential"originality"of the work and is an independent work rather than a copy of the original work.The digital works behind the tokenization of NFT have no value without"scarcity",and the forging act does not add value to the NFT,and the NFT digital collection itself does not have value.[Conclusions]The value of NFT's digital collections comes mainly from copyright licensing outside the act of casting or from the"dumber theory".
