摘要

[目的]通过分析我国知识产权保护现状,探讨协同保护的价值及其困境,并提出相应解决方案,以期构建更高效的知识产权保护体系.[方法]借助案例分析,梳理并比较司法、行政等多方视角下知识产权保护模式的优缺点.[结果]指出协同保护模式的重要性,同时也对该模式在实践中面临的合作机制构建、利益协调等问题进行剖析.[结论]针对现有知识产权协同保护机制中存在的问题,保护主体需要加强沟通协作、扩大保护范围、注重整合资源、增强服务能力,并引入更加多元的力量参与,进一步推进机制创新,以改进和完善当下的知识产权保护格局.

Abstract

[Purposes]This paper analyzes the current situation of intellectual property protection in our country,explores the value and dilemma of collaborative protection,and puts forward the corresponding solution in order to build a more efficient intellectual property protection system.[Methods]The article uses case analysis to sort out and compare the advantages and disadvantages of intellectual property pro-tection mode from judicial and administrative perspectives.[Findings]This paper points out the impor-tance of cooperative protection mode,and at the same time,it also analyzes the problems of cooperation mechanism construction and interest coordination faced by this model in practice.[Conclusions]Aiming at the problems in the existing collaborative protection mechanism of intellectual property rights,the ar-ticle puts forward the need to strengthen communication and cooperation among protection subjects,ex-tend the protection,focus on integrating resources,enhance service capability,and introduce more di-verse forces to participate,further promote institutional innovation to improve and perfect the current pat-tern of intellectual property protection.
