Research on the Optimization of Green Patent Legal System Based on the Implementation of the"Dual Carbon"Goal
[Purposes]The rapid development of"green technology"is an accelerator for achieving the"dual carbon"goal,and the core of ensuring the rapid development of green technology is the relevant green patent legal system.Therefore,in the critical period of achieving the"dual carbon"goal,it is nec-essary to further improve the green patent legal system.[Methods]Through data collection and analysis,this paper understands the current status of green patent legislation,law enforcement,and judiciary in China.[Findings]There are still loopholes in the legislation related to green patents,and the relevant le-gal system lacks specificity;coordination ability and professional talent among various departments in law enforcement;judicial efficiency is low,costs are high,and there is a lack of case guidance.[Conclu-sions]It is necessary to strengthen the"ecological"value orientation of patent law,guide the system of rapid patent examination and compulsory licensing to tilt towards green patents,introduce a green patent technology investigation officer system and build a"cross regional"administrative law enforcement sys-tem,establish a specialized trial mechanism for green patent cases and increase compensation for green patent infringement.
