从复审无效案例看专利审查中公知常识的合理使用

摘要
[目的]专利是企业体现其科技创新能力的重要支撑,而在专利实践中,创造性判断一直是专利审查中的重点和难点问题,对于公知常识的准确认定是确保评判创造性时结论正确的必要前提.[方法]结合复审无效实际案例,分析不同应用场景下认定公知常识时需要综合考虑的关键因素.[结果]对于公知常识的使用,应当分别从其公开的技术特征与待证明事实之间的关联性、技术领域的差异、最接近现有技术的改进动机、技术特征之间的协同作用等多个角度予以综合考虑.同时,在书面证据举证困难的情况下,应当对其充分进行说理,并详述认定的逻辑过程加以佐证.[结论]所列应考虑因素可为公知常识的准确认定提供参考,助力创造性审查的客观公正.
Abstract
[Purposes]Patents are important support for businesses to embody their technical innovation capabilities.Creativity judgment has been significant and difficult problem in patent practice,and accu-rate identification of common knowledge is necessary prerequisite for correct conclusion of creativity judgment.[Methods]Critical factors that need to be considered comprehensively in identifying common general knowledge in different application scenarios were analyzed by reviewing invalid actual cases.[Findings]The use of common knowledge should be comprehensively considered from the perspectives of the correlation between its public technical characteristics and the facts to be proved,the differences in the technical field,the motivation for improvement closest to the existing technology,and the synergy between technical characteristics.At the same time,in the case of difficult proof of written evidence,it should be fully reasoned and supported by the logical process of detailed identification.[Conclusions]From above analysis,this paper hopes to provide reference for accurate identification of common knowl-edge to facilitate objective equality of creative judgment.
