Research on the Risks and Preventive Measures in the Transformation of Patented Technology Achievements of Colleges and Universities
[Purposes]The transformation of scientific and technological achievements in colleges and universities is an important way of scientific and technological innovation and economic development in our country.However,there are many risks in the process of patent transformation,resulting in patent be-ing shelved or abused.It is urgent to clarify the risks and preventive measures in the transformation of patent achievements in colleges and universities,so as to effectively improve the patent conversion rate of colleges and universities in China.[Methods]Based on the direction of our country's policies on the transformation of scientific and technological achievements,this paper conducts an empirical study on the judicial cases of the transformation of university patent achievements.[Findings]This paper summa-rizes the four risk categories of university patent transformation ownership disputes,contractual disputes caused by irregular agreements,patent right defect risks and undervalued patents.[Conclusions]It is suggested that universities should raise the awareness of risk prevention in the whole process of patent transformation,establish risk warning and prevention mechanism,and take targeted measures to deal with the four different types of risks.
